Starting a business in New York requires selecting a business structure (e.g., LLC, corporation, or sole proprietorship), filing formation documents with the New York Department of State, completing the publication requirement (for LLCs only) and obtaining any necessary licenses or permits. If you're a licensed professional, you must form either a PLLC or P.C., which require additional approvals from the New York State Education Department. Whether setting up a standard or professional business, we can work with you to select the proper corporate structure for your business and handle the filing requirements with the Education Department.
The processing time for a family-based green card depends on your relationship to the sponsor and your country of origin. Immediate relatives of U.S. citizens (spouse, parents, and unmarried children under 21) generally experience shorter wait times compared to other family preference categories, which may take several years. We can help you apply for Adjustment of Status or Consular Processing and seek a green card through your U.S. citizen or Legal Permanent Resident family member.
Unfortunately, New York State does not have a conversion process for converting a regular LLC or Corporation into a PLLC or P.C. You will need to start the processing over again by first obtaining approvals from the New York State Education Department. We can guide you through the filing process, ensuring compliance with all state regulations pertaining to professional businesses.
To bring your fiancé to the U.S., you must file Form I-129F with U.S. Citizenship and Immigration Services (USCIS). Once approved, your fiancé can apply for a K-1 visa at the U.S. embassy or consulate abroad. After arriving in the U.S., you must marry within 90 days, after which your spouse can apply for adjustment of status to a green card holder. We can assist with the overall process and deal with USCIS and the U.S. embassy, ensuring that your petitions are filed correctly and on time.
To apply for U.S. citizenship through naturalization, you must be a lawful permanent resident for at least 5 years (or 3 years if married to a U.S. citizen), have continuous residence, meet physical presence requirements, demonstrate good moral character, and pass an English and civics test.
